1. The writ petition is filed to command the respondent authorities to pay a sum of Rs. 1,61,1673/- towards the supply of milled rice of 675.48 Quintals.

2. The brief facts of the case are that the petitioner is a Miller and the respondent BSFC has entrusted the petitioner for a total paddy of 675.48 Quintals @ Rs. 2376/- per Quintal for the year 2016-17. The petitioner supplied 675.48 Quintals

Patna High Court CWJC No.24917 of 2018 dt.21-08-2025 2/3 of rice to the BSFC, Saharsa on 29.06.2017, 10.07.2017 and 11.07.2017 .

Learned counsel for the petitioner submits that the District Cooperative Officer, Saharsa vide memo no. 973 dated 18.09.2018 (Annexure-2) requested for fund from the Director, Cooperative Society, Bihar, Patna. Thereafter, the District Manager, SFC, Saharsa on 10.10.2018 issued letter no. 1026 (Annexure-3) addressing District Cooperative Officer, Saharsa informing that for payment of the dues of the milled rice, a request for fund from the Corporation Headquarter, Patna has been made and as and when the said fund is received, payment will be made.

4. It is the specific contention of the Learned counsel for the petitioner that till date he has not received any payment and the representation preferred by the petitioner is still pending before the Authority.

5.Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

6. The Learned counsel for the respondents

Patna High Court CWJC No.24917 of 2018 dt.21-08-2025 3/3 suggested that a fresh representation may be filed by the petitioner with all relevant documents to enable the respondents to pass appropriate order to the petitioner.

Considering the said fact that the representation was filed long back, this Court directs the petitioner to file a fresh representation along with all relevant documents within one month from the date of receipt of this order and in turn the District Manager, BSFC, Saharsa shall consider all the materials on record, on merits, in accordance with law and shall pass appropriate order within three months from the date of filing of the representation.

8. With the aforementioned observation, the writ petition stands disposed of.
