JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-10-2023 The present writ petition has been filed seeking the following relief:- "1.That this is an application for issuance of an appropriate writ, order or direction commanding upon the respondents to remove encroachment from the Public Road whose details are as follows- R.S.

"Gairmajarua Khatiyan mentioned as Aam Land, bearing Khata No.

168, Khesra No. 953 at village

Patna High Court CWJC No.3991 of 2023(2) dt.09-10-2023 2/2 Laxmipur, Anchal Chanpatiya District-West Champaran which has been encroached by Respondents no. 7, 8 and 9 who have already constructed house over land in question and started living there and illegal created Jamabandi with respect to the public land in acquired to be cancelled and removed the encroachment of Plot No. 953. Thus not removing encroachment on the above noted Public Road."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, for redressal of the aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
