JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 302, 120(b) of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the son of the informant was called by the co-accused Ranjeet Chaudhary, who took him away to Maithil chowk and the informant also followed them from behind. In the meantime, the petitioner along with co-accused Abhimanyu Kumar caught hold of the hands of the deceased and thereafter, co-accused Vishal Yadav, at the instance of Usha Devi, fired pistol upon the son of the informant who died on the way to Siliguri for treatment.

It is submitted on behalf of the petitioner that specific

Patna High Court CR. MISC. No.19124 of 2023(2) dt.26-06-2023 2/2 allegation of firing upon the deceased is against co-accused Vishal Yadav. This petitioner along with co-accused Abhimanyu Kumar are alleged to have caught hold the hands of the deceased. He further submits that co-accused Abhimanyu Kumar has already been granted bail by the co-ordinate Bench of this Court vide order dated 16.05.2023 passed in Cr. Misc. No. 44927 of 2023.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Town (Sahayak) P.S. case no. 283 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
