JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-03-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Minapur Police Station Case No. 89 of 2015, disclosing offences under Sections 414, 420 and 120B of the Indian Penal Code.

The informant is Assistant Sub-Inspector of Police. It is alleged that the informant, on information that few persons were engaged in sale and purchase of motorcycle and were also causing annoyance, visited the place of occurrence, whereafter few of them fled away. The police is said to have apprehended one Raju Kumar, along with a Hero Honda motorcycle, who is said to have disclosed the names of the petitioner and others. Learned Counsel for the petitioner states that said Raju Kumar has been granted regular bail by this

Patna High Court Cr.Misc. No.6796 of 2016 (2) dt.14-03-2016 2/2 Court, vide order dated 20.07.2015, passed in Criminal Misc. No. 24268 of 2015. He further submits that the petitioner has no criminal antecedent and there is no chance that he will flee from the course of investigation or trial.

Considering the facts and circumstances, as noted above, this application is allowed.

Let the petitioner, Raghuvir Rai, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Minapur Police Station Case No. 89 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
