JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Allegation against the petitioners is that they robbed the informant while the informant was travelling as passenger on a tempo being driven by petitioner Tulsi Yadav.

Patna High Court Cr.Misc. No.13606 of 2017 (3) dt.10-04-2017 2/2 Submission of the petitioners is that due to dispute relating to payment of fare, present false case has been lodged.

Considering the nature of allegation and similar type of cases against the petitioners, I am not inclined to enlarge them on bail for the present in connection with Bihiya Police Station Case No. 296 of 2016 pending in the court of learned Additional Chief Judicial Magistrate-V, Bhojpur, Ara. Hence, prayer for bail is refused.

The learned trial court is directed to expedite the trial and conclude the same preferably within nine months from the date of receipt of a copy of this order, failing which the petitioners may renew their prayer for bail before the learned court below itself.
