Heard learned counsel for the petitioner and learned APP for the State.
The petitioner is languishing in custody since 21.10.2018 in a case registered for the offences punishable under Sections 341, 323, 504 of the Indian Penal Code and Section 37(c) of Bihar Prohibition and Excise Act, 2016. It is alleged against the petitioner that the petitioner being the brother-in-law of the informant was abusing the informant including her family members in intoxicated condition.
It is submitted by learned counsel for the petitioner that the petitioner has maliciously been roped in the present case.
Learned APP submits that the petitioner was
Patna High Court CR. MISC. No.12532 of 2019(2) dt.01-03-2019 2/2 apprehended in intoxicated condition.
Though the petitioner is accused in four other cases of similar nature but considering the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned IInd Additional Sessions Judge cum Special Judge, Excise, Madhubani in connection with Arer P.S. Case No. 176 of 2018.
