The petitioners being parents of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B/34 and 120B of the of the Indian Penal Code.
The accusation is of killing the daughter of the informant after fiver years of marriage for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioners that petitioners were not sent up for trial and after completion of investigation, the police submitted chargesheet but differing with
Patna High Court Cr.Misc. No.13549 of 2015 (2) dt.07-05-2015 2/2 the Final Form cognizance has also been taken on 17.12.2014. Considering the thrust of accusation against the husband of the victim and the petitioners being not sent up for trial, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari in connection with Mehshi P.S. Case No.110 of 2010 subject to the conditions as laid down under Section 438(2) Cr.P.C.
Learned court below will be at liberty to cancel the bail bonds of the petitioners if the petitioners default for three consecutive occasions.
