JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-01-2021 Heard Mr. Balram Kapri, learned counsel for the petitioner and Md. Aslam Ansari, learned APP for the State. The petitioner seeks bail in connection with Shambhuganj P.S. Case No. 267 of 2019, dated 11.11.2019, instituted for the offences under Sections 354(B) and 34 of the Indian Penal Code and Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012.
It has been alleged in the First Information Report that an attempt was made by the petitioner and others for outraging the modesty of the victim. The victim, in her
Patna High Court CR. MISC. No.10234 of 2020(7) dt.06-01-2021 2/2 statement under Section 164 Cr.P.C., has not alleged any specific act of misdemeanor against the petitioner. According to the instructions received by the counsel for the petitioner, there has been no development in the trial before the Court below.
The petitioner is said to be in custody since 30.11.2019 and in the other cases in which he was earlier made accused, he has been granted bail.
Considering the period of custody of the petitioner and little likelihood of the trial being concluded in near future, the petitioner, above-named, is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-I, Banka in connection with Shambhuganj P.S. Case No. 267 of 2019.
