JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 409 of the Indian Penal Code.

The prosecution case is that with regard to land of the informant Jamabandi was created in favour of purcha holder and thereby rent receipt was issued. At the relevant time, the petitioner was Revenue Karamchari.

It is submitted by learned counsel for the petitioner that Jamabandi was created by the senior officers of the petitioner and in departmental proceeding the petitioner has been exonerated from the charges. Moreover, the order of creating Jamabandi is

Patna High Court Cr.Misc. No.6814 of 2016 (2) dt.15-02-2016 2/2 amenable to challenge before the superior court. Considering the nature of accusation and the fact that the petitioner has been exonerated from the charges in the departmental proceeding, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sikrahana at Dhaka in connection with Chiraiya P.S. Case No. 43 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
