The petitioner apprehends his arrest in connection with Kurtha (Manikpur) P.S. Case No. 168 of 2016 registered under Sections 392 and 411 of the I.P.C. pending in the Court of C.J.M., Arwal.

Submission is that petitioner is not named in the F.I.R. and nothing has been recovered from the house of the petitioner. Further submission is that petitioner has been made accused in this case on the basis of confessional statement. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission that in course of investigation, the petitioner was boarded on the

Patna High Court Cr.Misc. No.11999 of 2017 (3) dt.10-05-2017 2/2 looted truck and there is direct allegation against him about his involvement in the commission of dacoity along with his other associates.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
