The petitioner seeks bail in Rafiganj P.S. case No. 31 of 2011 under Section 392 of the Indian Penal Code. The learned counsel for the petitioner submits that petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The petitioner is in jail since 23.08.2016 but it appears from the case diary that looted mobile was used by the petitioner and petitioner put the SIM bearing No.8651813394 in the mobile, which was issued in the name of the petitioner. The petitioner has got criminal antecedent. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the same is rejected.
The petitioner may renew his prayer for bail after remaining one year in custody.
