In paragraph '22' of the writ application, a statement has been made that being aggrieved by and dissatisfied with the order of dismissal, the petitioner has filed a departmental appeal before the Additional Director General of Police (Budget, Welfare and Appeal), Bihar, Patna on 18.04.2022 which is still pending.

Learned counsel for the petitioner informed this Court

Patna High Court CWJC No.3462 of 2023(2) dt.05-04-2023 2/2 that his appeal has been sent to the ADG, Police, Training Academy, Rajgir for consideration.

Learned counsel prays for a direction to the competent appellate authority to consider the appeal of the petitioner in accordance with law and pass a reasoned order. Ms. Divya Verma, learned AC to AAG-3 is present for the State. She has no objection to the kind of prayer made on behalf of the petitioner.

Considering that the appeal is pending for more than eight months, this Court directs the appellate authority (respondent no. 4) to consider and dispose of the appeal by a reasoned order in accordance with law within a period of two months from the date of receipt/production of a copy of this order.
