Learned counsel for the petitioner seeks and is granted permission to make necessary correction in the petition during the course of the day.
The petitioner is the wife of the opposite party, namely, Siddharth Raj, who has filed this application for transfer of Divorce Case No. 155 of 2020 from the Principal Judge, Family Court, Chapra to Principal Judge, Family Court, Hajipur. It has been contended by learned counsel for the petitioner that the notice has been validly served upon the sole opposite party.
Patna High Court MJC No.828 of 2021(5) dt.04-07-2022 2/2 The petitioner is unemployed and has no source of income. She is staying with her parents at their house in Hajipur and it is causing much inconvenience to her to travel to Chapra from Hajipur to contest the divorce case.
Considering the facts of the case, the Divorce Case No. 155 of 2020 is directed to be transferred from the Principal Judge, Family Court, Chapra to Principal Judge, Family Court, Hajipur.
After transfer of the case in the Court of Principal Judge, Family Court, Hajipur, the Principal Judge, Hajipur, will issue notice to both the parties and, thereafter, the proceeding will continue in the Court of Principal Judge, Family Court, Hajipur.
With the aforesaid observation and direction, this application is allowed.
