The petitioner apprehends his arrest in a case registered for the offence punishable u/s 341, 494, 307, 323, 504, 506, 509, 498(A) and 34 of IPC.

As per prosecution story, one Heena Khatoon was employed as maid at the quarter of the petitioner, but after having found her in compromising position with the petitioner, the informant (wife of the petitioner) ousted her from the quarter due to which the petitioner abused and assaulted the informant

Patna High Court CR. MISC. No.18807 of 2023(4) dt.18-11-2024 2/3 and ousted her and her daughter from her matrimonial house. It is further alleged that the petitioner stopped giving maintenance to informant and her children and tried to kill her by pressing her neck.

It is submitted by learned senior counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. It is submitted that petitioner has always performed the duty of a husband without fail. O.P. No. 2 having mentally sick attitude used to quarrel with the petitioner and used to make false linkups of petitioner with his female colleagues due to which petitioner was living separately from O.P. No. 2. Due to this reason, petitioner was compelled to file Matrimonial Case No. 288 of 2022 for dissolution of marriage between them. O.P. No. 2 has filed several cases against the petitioner to harass and torture him. Chargesheet has been susbmitted.Petitioner has three criminal antecedent as mentioned in para 3 of the bail application.

Learned APP for the State opposed the prayer for bail by submitting that petitioner has not taken positive steps for settlement with his wife rather he married with another girl

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Digha P.S. Case No.474 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. 7.

However, the petitioner shall remain physically present in the court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
