2. In this present case, the petitioner seeks bail in connection with Ramgarhwa P.S. Case No. 243 of 2024 registered on 03.01.2024 for the offences under Sections 304(2) and 61(2) of the B.N.S.
3. As per prosecution case, two persons in a CNG auto, overtook the motorcycle of the informant and snatched a bag containing Rs. 2,50,000/- collected from different places. The riders tried to flee away with their booty but the informant gave them chase on his motorcycle. However, the persons sitting in the auto hit the associates of the informant with rod. When the informant raised alarm, two motorcycle borne msicreants reached there and threatened him with life.
Patna High Court CR. MISC. No.11659 of 2025(2) dt.06-03-2025 2/3 Thereafter, the driver of the auto gave them the bag containing the money and all of them fled away from the spot. The name of the petitioner transpired in this case during investigation for being involved in the robbery.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner was not apprehended from the spot and nothing incriminating has been recovered from the conscious possession of the petitioner. Petitioner and co-accused Bhola Shankar recorded their confessional statement and admitted their guilt. In this case, though the police found the case true under Section 309(4) of BNS but the investigation is still going on. Petitioner is the owner of the auto which was used in the crime. There is no material on record to connect the petitioner in the offence as alleged. Petitioner is in custody since 05.10.2024 and charge-sheet has been submitted. Petitioner is having clean antecedent.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the clean antecedent of the petitioner as well as his period of

No.11659 of 2025(2) dt.06-03-2025 3/3 custody and submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran/concerned court in connection with Ramgarhwa P.S. Case No. 243 of 2024, subject to the conditions mentioned in Section 437(3) of the Code of Criminal Procedure and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
