This application for regular bail arises out of Chandi P.S. Case No. 526 of 2020, disclosing the offence punishable under Sections 406, 419, 420, 467, 468 and 120-B of the Indian Penal Code.
It is alleged against the petitioners and others that they duped the informant and several other persons in the name of providing them public employment. They are said to have extracted huge amount from the informant and others and handed over to them fake, forged and fabricated appointment letters depicting fraudulently their appointment in various
Patna High Court CR. MISC. No.22762 of 2021(3) dt.29-11-2021 2/3 offices under the Government of India, this High Court and civil courts as well as the State Government offices. Mr. Ashok Kumar Choudhary, learned Senior Counsel appearing on behalf of the petitioners has argued that the petitioners have been falsely implicated in the criminal case, to pre-empt them from insisting on paying back the amount which the informant and his family members had taken on loan. He has also submitted that the informant's son and others had kidnapped the petitioners forcibly and when upon information the police arrested some persons, the informant lodged a false criminal case against the petitioners and others. Mr.
Choudhary has further submitted that the police during course of investigation have not found any trail of money alleged to have been received by the petitioners and other accused persons. I have perused the case diary, from which it appears that the witnesses have supported the case of the prosecution as alleged in the FIR. There are materials in the case diary which indicate that the accused persons, with an assurance to resolve the dispute, had called the victims at a place and got them arrested in a case registered for kidnapping.
Patna High Court CR. MISC. No.22762 of 2021(3) dt.29-11-2021 3/3 investigation, I am not inclined to grant the petitioners privilege of regular bail for the present. This application is accordingly rejected.
The petitioners shall, however, be at liberty to renew their prayer for grant of regular bail after six months, if, in the meanwhile, there is no substantial progress at the trial. (Chakradhari Sharan Singh, J) Rajesh/- U T
