1. Heard Mr. Nafisu Zzoha, learned counsel for the petitioner and Mr. Satyendra Prasad, learned APP for the State.
2. The petitioner apprehends his arrest in connection with Supaul P.S. Case No. 224 of 2024 dated 01.04.2024 registered for the offence(s) punishable under Section(s) 147, 148, 447, 323, 379, 384, 376, 504, 506 read with Section 34 of the Indian Penal Code.
3. The main submissions advanced by the learned counsel for the petitioner are that the prosecution story relates to the alleged offence of rape revealed by the complainant in her complaint but the allegation is completely false and fabricated on account of the petitioner having participated in a Panchayat meeting relating to a land dispute admittedly running in between the complainant and one Mst. Raushan Khatoon, as per the

No.13675 of 2025(2) dt.28-03-2025 2/3 complaint, the alleged occurrence is said to have been committed on two dates 09.01.2024 and 11.01.2024 but on the last page of the complaint, which is typed, the complainant's Advocate's signature shows the date 15.12.2023 clearly indicating that the entire prosecution story was fabricated by the complainant with the help of legal brain. It is further submitted that the petitioner has fair and clean antecedent and there is no medical evidence in support of alleged rape and the main dispute running in between the complainant and co-accused Mst. Raushan Khatoon is of civil nature and to create pressure upon the said Mst. Raushan Khatoon as well as other accused persons including the petitioner, a false story has been created by the complainant.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the aforesaid submissions advanced by petitioner's counsel, this court is inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Supaul P.S. Case No. 224 of 2024 on furnishing bail bond of Rs. 20,000/-
Patna High Court CR. MISC. No.13675 of 2025(2) dt.28-03-2025 3/3 (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the BNSS. (Shailendra Singh, J) Rajiv/- U T
