Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code and 3/4 of the Witch Craft Practices Act.

Accusation is of killing the grand mother of the informant and disposing of the dead body after cutting the dead body into pieces. It is also alleged that the petitioners used to address the victim as witch.

It is submitted by the learned counsel for the petitioners that only on suspicion the accusation has been levelled. The Witness Ram Bahadur Sahni, whose statement has been recorded in para-5 of the case diary has disclosed the

Patna High Court Cr.Misc. No.6732 of 2016 (2) dt.15-02-2016 manner of occurrence as to how the accused persons committed murder of the victim, but the said witness has not named the petitioner.

Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Khagaria (Gangaur) P.S. Case No. 746 of 2015, pending in the court of learned Chief Judicial Magistrate, Khagaria. With the above observation this application is disposed of.
