This application has been filed under Article 227 of the Constitution of India for issuance of a direction commanding the Court of learned Munsif I, Darbhanga to execute judgment and decree passed in Title Suit No.9 of 2000 expeditiously in Execution Case No.8 of 2001.
So far this relief is concerned, it may be mentioned here that this Court exercises supervisory jurisdiction and while exercising supervisory jurisdiction in judicial side, the order of any inferior Court is to be examined to see that by the order whether any injustice has been done to any party or failure of justice has occasioned or not. The High Court also examines as to whether the Court below has acted beyond the jurisdiction or in the manner not permitted by law.
Patna High Court CWJC No.3443 of 2014 (2) dt.08-01-2016 In supervisory jurisdiction, this Court cannot monitor each and every case pending before the Courts all over the State of Bihar and, therefore, for this general direction, the application under Article 227 of the Constitution of India is not maintainable.
