JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-03-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners seek bail in connection with G.R.P. D.B. G/ S.M.I. P.S. Case No. 91 of 2016 registered under Section 370 of the Indian Penal Code and section 16 of the Bounded Labour Systems Abolition Act.

Learned counsel for the petitioners submits that nothing has been recovered from the possession of the petitioners. Parents of the recovered children did not say anything against the petitioners. It is a clear case of plantation by the police. Petitioners have no criminal antecedent and are in

Patna High Court Cr.Misc. No.4207 of 2017 (2) dt.08-03-2017 2/2 custody since 28.10.2016. Similarly situated co-accused persons have been granted bail by this Court 07.02.107, 16.02.2017 and 22.02.2017 passed in Cr. Misc. Nos. 2461 of 2017, 6760 of 2017 and 7841 of 2017 respectively. Considering the facts and circumstances of the case, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate (Rail), Samastipur in connection with G.R.P. D.B. G/ S.M.I. P.S. Case No. 91 of 2016.
