2. The petitioner seeks bail in connection with Phulwarisharif P.S. Case No. 1867 of 2025, instituted for the offences punishable under Sections 115(2), 126(2), 318(4), 308(5), 303(2), 352, 351(2), 351(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that the informant was lured to an isolated place at Phulwari Sharif by a person who had earlier visited his branch, where he along with 2-3 associates allegedly assaulted the informant, snatched his gold chain, threatened him with death, forcibly transferred Rs. 35,000/- to the account of Md. Azad through a QR code,

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submitted that the petitioner is not named in the FIR. Name of the petitioner has transpired in this case on the basis of confessional statement made by co-accused person and the same has got no evidentiary value. It is next submitted that no specific allegation has been attributed against the petitioner rather the same is general and omnibus in nature. It is further submitted that the informant was involved in gay-sex and for that purpose the informant used to visit many places and made physical relation. During investigation, the I.O. has taken third statement of the informant where the informant has accepted that due to fear of public shame he did not say the true fact. The petitioner is in custody since 22.11.2025 and has got one criminal antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Phulwarisharif P.S. Case No. 1867 of 2025.
