JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 394 and 411 of the Indian Penal Code and sections 25(1-b) a, 26,27 and 35 of the Indian Arms Act.

Taking into consideration that petitioner was caught on the spot just after the alleged occurrence and some articles as well as firearm were recovered from conscious possession of the petitioner, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Govindganj ( Areraj) P.S.Case No. 311 of 2018, pending in the court of learned Additional Chief Judicial Magistrate-I, Motihari
