This is an application for bail in connection with Naugachia P.S.Case No. 149 of 2016, corresponding to Sessions Trial No. 05 of 2017, registered for the offences punishable under Sections 147, 148, 149, 302, 120B of the Indian Penal Code and 27 of the Arms Act.

Submission of learned counsel for the petitioner that he has falsely been implicated in this case only on the basis of suspicion. Further the deceased himself was a veteran criminal and he might have been killed by one of his enemies. It has also been submitted that now the trial is at the concluding stage and petitioner has been in judicial custody since 12.11.2016.

Patna High Court Cr.Misc. No.13881 of 2017 (3) dt.04-08-2017 Heard learned APP and learned counsel for the informant also.

Considering the fact that now the trial is at concluding stage, I am not inclined to grant bail to the petitioner at this stage. However, learned trial court is directed to conclude the trial within a period of three months positively.
