The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 379, 467, 468, 471 and 120B of the Indian Penal Code.

As per the prosecution case, on a raid being conducted, five accused persons including the petitioner herein were caught and it is stated that a screen touch mobile phone besides other articles as mentioned in the FIR have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. His case stands on a similar footing to that of co-accused Uday Kumar who has been enlarged on bail vide order dated

Patna High Court CR. MISC. No.22098 of 2021(2) dt.04-10-2021 2/2 16.4.2021 passed in Cr. Misc. no. 9068 of 2021, Vikash Kumar @Vikesh Kumar who has been enlarged on bail vide order dated 1.7.2021 passed in Cr. Misc. no. 13933 of 2021 and Sujit Kumar who has been enlarged on bail vide order dated 30.7.2021 passed in Cr. Misc. no. 12051 of 2021. The petitioner is in custody since 22.10.2020 and has no criminal antecedent. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for more than 11 months and grant of bail to the three above named co-accused, the Court directs the petitioner to be enlarged on bail in connection with Kankarbagh P.S. Case no. 834 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna. (Partha Sarthy, J) Prakash/- U
