JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 171(F) of the Indian Penal Code and Section 27 of the Arms Act.

The accusation against the petitioner is of causing firearm injury to the informant on the eve of PACCS election. It is submitted by learned Senior Counsel for the petitioner that the injury has been found to be simple and even assuming the accusation, the case does not come within the purview of Section 307 IPC. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.9363 of 2015 (3) dt.23-03-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with MMCH P.S. Case No. 143 of 2014 pending in the court of learned ACJM, Gaya.

Accordingly, the application is disposed of.
