JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rampur P.S. Case No. 45 of 2014, registered for the offences punishable under Sections 364, 120B/34 and later on Sections 302, 365, 210/34 of the Indian Penal Code were added.

Prosecution case is that husband of the informant was called by Jogi Yadav, Brajesh Kumar and one unknown person and thereafter they had gone together and thereafter her husband did not return and he was traceless and the informant apprehended his abduction by those accused persons. It appears that petitioner is not named in the FIR and later on during investigation his name transpired.

Submission of learned counsel for the petitioner is that except that he was seen along with other accused persons

Patna High Court CR. MISC. No.13283 of 2019(3) dt.01-05-2019 2/2 there is absolutely nothing against him in the FIR and the case is of the year 2014 and learned Sessions Judge has also observed that the case is still under investigation.

Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Gaya, in connection with Rampur P.S.Case No. 45 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that the petitioner has to appear before the Investigating Officer as and when required, otherwise his bail bond shall be cancelled.
