This is an application for bail in connection with Dinara P.S.Case No. 174 of 2016 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that petitioners are father-in-law and mother-in-law of the deceased and they are in custody for five months and four months respectively. According to learned counsel for the petitioners, that it has come during course of investigation that deceased had a talk with her husband, who is living at Rajkot and thereafter she committed suicide by hanging herself and there is no complicity of the petitioners in commission of her death.

Heard learned APP also, who has opposed the prayer for bail stating that in paragraph-8 and other paragraphs of the case diary it has come that some witnesses have supported the defence version.

No.4263 of 2017 (3) dt.06-04-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Bikramganj, Rohtas, in connection with Dinara P.S.Case No. 174 of 2016, subject to the conditions that :- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move for cancellation of their bail.
