Petitioner seeks bail in a case registered for the offences punishable under Sections 307,323,341/34 of the Indian Penal Code and later on Section 302 I.P.C. was added. The son of the brother of the informant was allegedly murdered by his inlaws when he wanted to bring his wife to his house. Informant is not an eye witness of the occurrence rather eye witnesses, who had seen the occurrence, specifically stated that Krishna Prasad, the husband of this petitioner and father-in-law of the deceased, had caused injury at the head of the deceased, as a result whereof, he died. Learned counsel for the informant opposed the prayer for bail on the ground that allegation of commission of
Patna High Court CR. MISC. No.11314 of 2019(3) dt.06-05-2019 2/2 assault is against other family members also including the petitioner.
Considering the entire facts, let the petitioner, above named, who is in custody since 21.10.2018, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Islampur Police Station Case No.358 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
