JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-02-2019 The petitioner seeks bail in anticipation of her arrest in connection with Nimchak Bathani P.S. Case No. 13 of 2019 dated 27.01.2019 instituted for the offences under Section 30(A) of the Bihar Prohibition & Excise Act, 2016. Around fifteen litres of liquor is said to have been recovered from outside the house of the petitioner. The learned counsel for the petitioner has submitted that the implication of the petitioner is only on the basis of secret information provided to the Police. The petitioner has clean antecedents.

Regard being had to the fact that there is no recovery from the possession/constructive possession of the

No.11184 of 2019(2) dt.25-02-2019 2/2 petitioner and her clean antecedents, the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on her furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge(Excise), Gaya in connection with Nimchak Bathani P.S. Case No. 13 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
