For the Petitioner/s : Mr. Amit Kumar Anand, Adv. For the Opposite Party/s : Mr. Anuj Kr.Srivastav(APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 24-06-2015 Heard both sides.

The petitioner apprehends his arrest in Kasba P.S. Case no 182 of 2014, registered for the offences punishable under Sections 307 and other Sections of the Indian Penal Code. The mother of the deceased made allegation that Jagdish Mahto, Anandi Mahto and others inflicted Garasa blow on the shoulder of her son.

It is submitted that one injury is found on the shoulder of the son of the informant and two persons are alleged to have assaulted with Garasa. There is a counter version. Even during course of investigation independent witnesses have stated that Anandi Mahto inflicted Garasa, not the petitioner. There appears that the informant made very specific

Patna High Court Cr.Misc. No.10996 of 2015 (3) dt.24-06-2015 2/2 allegation that the petitioner and Anandi Mahto gave Garasa blow. Of course, there is one injury, but the injury is grievous in nature, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
