JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rail Sonepur P.S. Case No. 84 of 2016 instituted for the offence under Sections 379 and 411 of the Indian Penal Code.

It has been submitted that there is no recovery of any incriminating article from the possession of the petitioner. His name has transpired only on the basis of CDR report of the stolen mobile. It has further been submitted that the co-accused Dhiraj Kumar has already been granted bail by a coordinate Bench of this Court vide order dated 21.2.2017 passed in Cr. Misc. 7794 of 2017. It is mentioned in paragraph-3 of the bail petition that the petitioner has clean antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.11090 of 2017 (2) dt.18-03-2017 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Sonepur, Saran at Chhapra, in connection with Rail Sonepur P.S. Case No. 84 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
