The petitioner seeks regular bail in connection with East Champaran Mufassil P.S. Case No. 350 of 2016, registered for offences punishable under Sections 420, 328, 379, 414/34 of the Indian Penal Code.
The allegation, in brief, is that the petitioner gave lift to the Informant in his car thereafter offered him cold drink mixing some intoxicant as a result the informant became unconscious and then committed theft of his purse containing Rs. 3700/- and other documents like Adhar Card, I. Card and thrown him out of the running vehicle and fled away; but he was apprehended by the local people after a brief chase.
Patna High Court Cr.Misc. No.22338 of 2017 (2) dt.10-05-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that earlier the petitioner moved for bail which was rejected at that stage by order dated 8.3.2017 with an observation to renew the prayer for bail after framing of charge. Now the charge has been framed in this case against the petitioner on 27.3.2017.
Considering the fact that the charge has been framed against the petitioner as well as the period of custody, Surendra Mahto, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with East Champaran Mufassil P.S. Case No. 350 of 2016 with the condition that one of the bailors must be his close relative.
