The Petitioner seeks bail in Ghanshyampur P.S. Case No. 86 of 2016 instituted for the offence under Section(s) 20/22 of the Narcotic Drugs & Psychotropic Substances Act.
It has been submitted on behalf of the petitioner that there is no recovery from the possession of the petitioner. From the possession of co-accused Haribansh Yadav, total 12.5 Kg of Ganja is said to have been recovered. The said Haribansh Yadav has already been enlarged on bail vide order dated 18.10.2016 passed in Cr. Misc. No. 40157 of 2016 by a coordinate Bench of this Court.
Patna High Court Cr.Misc. No.21147 of 2017 (2) dt.09-05-2017 2/2 The petitioner is said to be in custody since 10.02.2017.
From the written report itself, it appears that petitioner was not apprehended on the spot and the alleged Ganja has been recovered from the possession of co-accused Haribansh Yadav.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judgecum-Special Judge, Darbhanga in connection with Ghanshyampur P.S. Case No. 86 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
