The petitioner seeks regular bail in connection with Mahila P.S. Case No. 29 of 2019 for the offence punishable under sections 376, 493, 34 of the Indian Penal Code and 3⁄4 of D.P. Act.

A co-ordinate Bench of this Court, vide order dated 29.02.2020, while issuing notice to the Opposite Party No.2 had granted the privilege of provisional bail to the petitioner and it is informed that the petitioner has also been released on provisional bail.

A bare perusal of the office report shows that the notice has been validly served on the Opposite Party no.2, however, she has chosen not to appear before this Court.

No.10458 of 2020(5) dt.06-12-2021 2/2 Having regard to the facts and circumstances of the case as also taking into account the fact that the opposite party no.2 and the petitioner were in relationship since two years and both are major, apart from considering the nature of allegations levelled against the petitioner, this Court deems it fit and appropriate to confirm the provisional bail already granted to the petitioner by a co-ordinate Bench of this Court. Accordingly, the order dated 29.02.2020 passed by a co-ordinate Bench of this Court granting provisional bail to the petitioner is made absolute.

The petition stands disposed of.
