The petitioners seek bail in Pratapganj P.S. Case No. 110/2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and Sections 27, 25(1-b)a, 26 and 35 of the Arms Act.
The informant named the petitioners and others and alleged that they all brutally assaulted Balram Mandal, brother of the informant. Anil Yadav, Petitioner No. 4 is also alleged to have fired at Balram Mandal.
Learned counsel for the petitioners submits that there is
Patna High Court Cr.Misc. No.12469 of 2017 (2) dt.22-03-2017 2/2 counter version.
From perusal of Annexure-4, it would appear that Balram Mandal got three injuries; one is pain in back waist and second is muscular swelling. The doctor opined that the injuries are simple in nature caused by hard blunt substance. The petitioners are in jail since 31.12.2016.
Considering the facts aforesaid and the fact that the petitioners have remained in jail for more than two months, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Birpur in connection with Pratapganj P.S. Case No. 110/2016.
