JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Khaira Police Station Case No. 141 of 2014 registered for the offences punishable under Section 304B/34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased who died in other then normal circumstances. Although the case was registered under section 304B/34 of the Indian Penal Code but admittedly, the marriage of the deceased had taken place ten years ago moreover, the informant claimed in his fardbeyan that prior to her death, deceased had disclosed the manner in which she was set on fire.

Patna High Court Cr.Misc. No.13150 of 2015 (3) dt.22-05-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to extent privilege of anticipatory bail to the petitioner and accordingly, his prayer for bail in connection with Khaira Police Station Case No. 141 of 2014, pending in the court of learned Judicial Magistrate 1st class, Jamui stands rejected.
