This application for anticipatory bail arises out of Mohania P.S. Case No. 553 of 2018 for the offence punishable under Sections 341, 323, 325, 307, 379 and 504/34 of the Indian Penal Code.

The petitioners are sons of co-accused Khedan Ram. There is allegation against said Khedan Ram that he was abusing indiscriminately all the villagers and on objection, the occurrence took place. There is allegation against Khedan Ram of having assaulted the informant with an axe. It is evident from the First Information Report that certain land dispute is the reason behind the occurrence.

Considering the nature of accusation, this

I have kept in mind that petitioner No.1 has criminal antecedent, as indicated in paragraph 3 of the application, yet he deserves the privilege of anticipatory bail in the facts and circumstances of the present case. Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabhua, in Mohania P.S. Case No. 553 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
