2. The petitioner is in custody since 23.09.2016 in connection with Barachatty P.S. Case No. 376 of 2016 for the alleged offences under Sections 8/17(B)/18(B)/25/29 of the N.D.P.S. Act.
3. It is submitted that the petitioner has been falsely implicated in connection with alleged recovery of 500 grams of opium from the truck of which the petitioner was the driver. It is submitted that in fact the 'khalasi' of the truck had taken the packets from the two persons who had come on glamour motor cycle. In any event, the quantity of the opium in question is well below commercial quantity.
4. Learned APP on the other hand points out from the FIR that it was in fact the petitioner who had taken the packet of opium from the said two persons which was found in the truck, of which the petitioner was the driver.
4. Having regard to the nature of accusations and
Patna High Court Cr.Misc. No.17873 of 2017 (2) dt.12-04-2017 gravity of the offence alleged, this Court is not inclined to grant privilege of bail to the petitioner. The bail petition stands dismissed.
