JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Alamganj P.R. Case No. 280 of 2019, registered under Sections 30(a), 41(1),41(2) and 32(1)(3) of the Bihar Excise Act. The accusation is of recovery of 864 bottles each containing 180 ml in the volume of 155.520 litres Indian made foreign liquor from the goods carrier tempo, which was being driven by the petitioner.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 21.12.2019.

Having regard to the facts and the circumstances of

Patna High Court CR. MISC. No.15557 of 2020(2) dt.14-05-2020 2/2 the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Alamganj P.R. Case No. 280 of 2019, Special Case No. 11404 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
