The petitioner apprehends his arrest in connection with Complaint Case No.369(C) of 2014 for the offences punishable under Sections 420, 468 and 504 of Indian Penal Code. The circumstances leading to filing of the present application seeking anticipatory bail stands discussed in the order of this court dated 27.1.2016 passed in Cr.Misc.No.3661 of 2016, a copy of which forms part of Annexure-1 series. It is pursuant to the liberty granted under the said order that the present application is filed.
Learned counsel for the petitioner has submitted that the petitioner is charged with executing a sale deed in favour of his son in respect of a land claimed by the complaint. He submits that
Patna High Court Cr.Misc. No.7656 of 2016 (2) dt.17-02-2016 2/2 raising a civil dispute that the present case has been filed. Learned counsel for the petitioner submits that an issue of title is involved in the dispute.
Having heard learned counsel for the parties and considering the nature of allegation, let the petitioner namely, Sitaram Singh in the event of his arrest/surrender within four weeks from today, be released on bail upon furnishing bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in connection with Complaint Case No.369(C)of 2014 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure.
