1. The Writ petition is filed for the following reliefs:

I. For issuance of direction upon the respondent authorities particularly upon the respondent No. 4 to pass order for restoring PDS license No.

67 of 2008 of the petitioner in the light of order dated 11.05.2018 passed by the respondent District Magistrate, Samastipur in PDS Appeal No. 22 of

Patna High Court CWJC No.24613 of 2018 dt.23-09-2025 2/3 2017.

II. For further to hold that in view of order passed by the District Magistrate, Samastipur in PDS appeal case No. 22 of 2017 dated 11.05.2018 there is no impediment in the way of respondent Sub-Divisional Officer, in passing fresh order for restoring license of the petitioner for the reason that he cannot remain sitting tight over the matter for indefinite period.

III. For any other relief or reliefs for which the petitioner is found entitled in the facts and circumstances of the case.

2. During course of the arguments, the Learned counsel for the petitioner reported to the Court that the petitioner has passed away and he intends to file an interlocutory application for substitution of the petitioner with his legal heirs.

3. The Learned counsel for the respondents contended that if at all the legal heirs of the petitioner

Patna High Court CWJC No.24613 of 2018 dt.23-09-2025 3/3 have any right, they have to make representation before the appropriate authority seeking compassionate appointment for grant of PDS license.

4. At this Juncture, the Learned counsel for the petitioner seeks liberty to file such a representation before the appropriate authority.

5. Accordingly, the Writ petition stand closed granting liberty to the legal heirs of the petitioner to file a representation before the appropriate authority for the grant of PDS license on compassionate ground.
