The petitioner seeks bail in connection with Thawe P.S. Case No.8 of 2017 registered under Sections 272, 273 of the I.P.C. and Section 30 (a ) of the Bihar Prohibition and Excise Act. The accusation is that on 19.01.2017 at 3.30.A.M. in course of checking of the vehicle, one vehicle bearing Registration No.BR 28L 8494 was intercepted while the driver and the owner of the vehicle succeeded to flee away. Chaukidar identified them as Munna Choudhary and Gufran Ali in the light of torch and the vehicle. On search of the vehicle 59 bottles each containing 750 ml. of Royal Stage Indian liquor were recovered from the vehicles.
Patna High Court Cr.Misc. No.14267 of 2017 (2) dt.08-04-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner is not the owner of the vehicle. In fact, the petitioner has been falsely implicated in this case as he was earlier driver of the vehicle which belongs to co-accused Gufran Ali. Further submission is that the petitioner has no criminal antecedent and is in custody since 20.02.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Gopalganj, in connection with Thawe P.S.
