This is a case of misuse of privilege of bail in a case relating to offence under Section 379 and 411 Indian Penal Code.

Submission is that prosecution evidence is going on and the petitioner would not default in future. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Ara/successor Court in connection with Tr. No. 766 of 2016 arising out of Piro Police Station Case No. 91 of 2002, with

Patna High Court Cr.Misc. No.20260 of 2017 (2) dt.01-05-2017 2/2 condition that in the event of any default by the petitioner, the court below shall be at liberty to cancel the bail bond and take him into custody till conclusion of the trial.
