JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-06-2022 After some argument, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to file an appeal against the order dated 16.06.2017 passed by the District Magistrate, Nalanda. Liberty so sought is granted. At this juncture, the learned counsel for the petitioner submits that the petitioner is not in possession of the certified copy of the said order dated 16.06.2017. This Court, in the facts and circumstances of the case, deems it fit and proper to waive the necessity of filing of appeal along with the certified copy of the order dated 16.06.2017 and grants permission to the petitioner to file appeal annexing the photocopy of the order dated 16.06.2017, which shall be liable to be verified by the appellate

The petitioner is granted four weeks' time to file the requisite appeal and in case such an appeal is filed before the appellate authority within a period of four weeks from today, the appellate authority shall consider the same in accordance with law and dispose of the same within a period of 8 weeks' thereafter.

At this juncture, the learned counsel for the petitioner submits that the issue of limitation be considered sympathetically by the appellate authority. It is directed accordingly.
