ABHISHEK REDDY ORAL ORDER 07-04-2026 Learned counsel appearing on behalf of the petitioners submits that the petitioners will give a suitable representation to the Sub-Divisional Officer, Sadar Begusarai, District-Begusarai i.e. Respondent No. 3 herein ventilating their grievance. Learned counsel prays that the Respondent No. 3 herein may be directed to consider the said representation and pass necessary orders by fixing a time frame.

Learned counsel appearing on behalf of the Respondent-State submits that he has no objection, if a representation is given by the petitioners to the Sub-Divisional Officer, Sadar Begusarai, District-Begusarai i.e. Respondent No. 3 herein ventilating their grievance and the authority may be directed to pass necessary orders strictly in accordance with law.

Having regard to the above made submissions, the present writ petition is disposed of granting liberty to the petitioners to give a representation to the Sub-Divisional Officer, Sadar Begusarai, District-Begusarai i.e. Respondent No. 3 ventilating their grievance within a period of 4 weeks from today. On receipt of the said representation, the Respondent No. 3 is directed to consider the said representation strictly in accordance with law and pass necessary orders as expeditiously as possible preferably within a period of 8 weeks from the date of the receipt of the representation from the petitioner. In case, the claim of the petitioners is found to be genuine, the authority shall take necessary steps for correction of the ePOS machine and in case the authorities comes to the conclusion that the claim of the petitioners does not merit any consideration, he shall pass a reasoned order giving the reasons for such rejection. It is needless to mention that before passing any order the
Patna High Court CWJC No.3193 of 2026(2) dt.07-04-2026 3/3 petitioners shall be given an opportunity of hearing. Any order passed shall be communicated to the party.
4. Till any decision is taken on the representation made by the petitioners, the authorities are directed not to take any coercive steps against the petitioners. In case, the representation is not filed within the stipulated time, the authority is free to take necessary action in accordance with law.
5. With the above directions, the present Writ Petition stands disposed of.
