JUSTICE SANJAY PRIYA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Special P.S. Case No. 16 of 2016 arising out of Kishanganj P.S. Case No. 399 of 2016 instituted for the offence under Sections 21, 22 of N.D.P.S. Act. It has been submitted on behalf of the petitioner that 6 kg. 200 grams of contraband Ganja has been recovered from possession of this petitioner. It has further been submitted that petitioner is a lady having clean antecedent. She is in custody since 27.8.2016. Charge sheet has also been submitted in this case.
As per table contained in the NDPS Act, the seized quantity is below the commercial quantity.
Patna High Court Cr.Misc. No.14650 of 2017 (3) dt.16-05-2017 2/2 Learned A.P.P. has submitted that FSL report has not been received.
Keeping in view the period spent by the petitioner in custody and she has clean antecedent, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Kishanganj, in connection with Special Case No. 16 of 2016 arising out of Kishanganj P.S. Case No. 399 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
