The petitioner is accused in connection with Haspura P.S. Case No. 217 of 2016, registered under Sections 820(b),(II)(A) of NDPS Act and 30(A) of Bihar Excise Act, 2016. The accusation is that on receiving secret information regarding selling of narcotics at the shop of Pankaj Prasad, the Police raided the shop of Pankaj Prasad from where 1.750 Kg 'Ganja', one bottle, containing 750 ML, India made foreign liquor and 6 bottles, each containing 375 ML, India made foreign liquor were recovered. The apprehended person disclosed that the narcotic is being supplied to him by this petitioner for sale.
Patna High Court Cr.Misc. No.6287 of 2017 (2) dt.08-03-2017 2/2 Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of the confessional statement of co-accused Pankaj Prasad from whose shop the alleged Ganja and liquor is said to be recovered. The petitioner has no criminal antecedent is in custody since 15.12.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Aurangabad, in connection with Haspura P.S. Case No. 217 of 2016.
