JUSTICE SATYAVRAT VERMA ORAL ORDER 12-10-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 498(A) and 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

By order dated 12.09.2022 the petitioner and the informant were directed to remain physically present on 11.10.2022, but when the case was taken up on 11.10.2022 the informant was present physically, but the petitioner did not appear and the learned counsel representing the petitioner submitted that on account of some personal difficulty the petitioner could not

Patna High Court CR. MISC. No.11995 of 2022(4) dt.12-10-2022 2/2 appear and thus sought forgiveness from the court which was accorded and the case was fixed for today. Today, when the matter was taken up again the informant was present but the petitioner did not appear, the learned counsel for the petitioner submitted that it appear that the petitioner does not intend to appear before the Court and thus is giving misleading instructions to him, it is next submitted that the petitioner had assured that he will appear today but again for reasons best known he has not appeared. Learned counsel thus very fairly submitted that based on the conduct of the petitioner he is not in a position to make any further submission. Considering the conduct of the petitioner, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

The Senior Superintendent of Police, Patna is directed to ensure that all coercive steps are taken to ensure that the petitioner is arrested forthwith and sent to prison. Let this order be communicated to the Senior Superintendent of Police, Patna forthwith.
