JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376/511, 323, 325 and 504 of the Indian Penal Code.

Accusation is of attempting to establish forceful physical relationship and assaulting the informant. It is submitted by learned counsel for the petitioner that the accusation has been levelled in the background of land dispute and the petitioner is agnate of the informant. The informant claimed fracture of her right hand and the impugned order also reflects that after X-ray fracture was found on right palm of the informant. The police, after investigation, submitted chargesheet under Sections 341,323,325,354 and 504 of the Indian Penal Code.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Laxmipur (Gidhor) P.S. Case No.72 of 2014, pending before the Sub-Divisional Judicial Magistrate, Jamui.

With the above observation, this application is, accordingly, disposed off.
