The petitioner seeks bail in a case registered under Sections 304, 379/34 of the Indian Penal Code.

Prosecution case, in short, is that accused persons including the petitioner assaulted the son of the informant and fled away with Rs.1,50,000/- and grand son. During treatment, the son of the informant died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.08.2018 and has got no criminal antecedent. Police report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The informant is not an eye witness to the alleged

Patna High Court CR. MISC. No.11976 of 2019(3) dt.09-04-2019 2/2 occurrence. Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioner in the present case. After investigation, the police found the case to be false and submitted final form.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-7, Bhagalpur in connection with Tatarpur P.S. case No.180 of 2018.
